महाराष्ट्र के ठाणे जिले की एक अदालत ने शनिवार को कांग्रेस नेता राहुल गांधी को राहत दी। अदालत ने राष्ट्रीय स्वयंसेवक संघ (आरएसएस) के एक पदाधिकारी द्वारा राहुल गांधी के खिलाफ दायर मानहानि मामले में पेश होने से स्थायी छूट दे दी। भिवंडी प्रथम श्रेणी के न्यायिक मजिस्ट्रेट सी वाडिकर ने राहुल गांधी के वकील नारायण अय्यर के माध्यम से दायर गांधी के आवेदन पर सुनवाई की और कहा कि कांग्रेस नेता स्थायी छूट के हकदार हैं। मजिस्ट्रेट ने स्थानीय आरएसएस कार्यकर्ता राजेश कुंटे द्वारा दायर मानहानि के मुकदमे में साक्ष्य दर्ज करने के लिए तीन जून की तारीख निर्धारित की है। कुंटे ने 2014 में गांधी के भाषण को देखने के बाद भिवंडी मजिस्ट्रेट की अदालत के समक्ष एक निजी शिकायत दर्ज कराई थी, जिसमें राहुल गांधी ने कथित तौर पर महात्मा गांधी की हत्या के लिए आरएसएस पर आरोप लगाया था। कुंटे ने दावा किया कि इस बयान से आरएसएस की प्रतिष्ठा को ठेस पहुंची है। गांधी जून 2018 में अदालत के सामने पेश हुए थे और उन्होंने खुद को निर्दोष बताया था। अदालत ने अपने आदेश में कहा कि आरोपी राहुल गांधी को अदालत द्वारा पारित अगले आदेश तक निम्नलिखित शर्तों के अधीन अदालत में पेशी से छूट दी जाती है। पहली शर्त में कहा गया है, आरोपी यह वचन देता है कि उसका विधिवत नामित अधिवक्ता समय-समय पर और नियमित रूप से प्रत्येक निर्धारित तिथि पर अदालत के समक्ष उपस्थित होता रहेगा और अभियुक्त की अनुपस्थिति में मुकदमे का संचालन करेगा। दूसरी शर्त में कहा गया है, निर्देश मिलने पर आरोपी को कोर्ट में पेश होना होगा। गौरतलब है कि राहुल गांधी को हाल ही में मानहानि के मामले में सूरत की अदालत द्वारा दोषी ठहराए जाने के बाद सांसद के रूप में अयोग्य घोषित किया गया था। उन्होंने पिछले साल इस आधार पर भिवंडी अदालत में पेशी से छूट मांगी थी कि वह दिल्ली में रहते हैं और लोकसभा सदस्य हैं, उन्हें उनके निर्वाचन क्षेत्र वायनाड का दौरा करने, पार्टी के काम में शामिल होने और बहुत ज्यादा यात्राएं करनी पड़ती है। इसलिए इस मामले में व्यक्तिगत पेशी से छूट दी जाए। गांधी ने अनुरोध किया था कि जब भी आवश्यकता हो, सुनवाई में उनके वकील द्वारा उनका प्रतिनिधित्व करने की अनुमति दी जाए। कुंटे ने हाल ही में तर्क दिया था कि चूंकि गांधी अब सांसद नहीं हैं, इसलिए उन्हें इस मामले में छूट नहीं दी जानी चाहिए।
